
Getting Married in India as Foreigners

The Indian legal system recognizes marriages between an Indian citizen and a foreigner, as well as marriages between two foreigners. The Special Marriage Act, 1954 governs such marriages.
In India you need following to get married as foreigners:
๐น To get married, you only have to visit the country once.
๐น Both individuals must possess valid passports as proof of their nationality and identity.
๐น The partners have to be in the country legally (for example, with a tourist visa).
๐น At least one of the individuals must have resided in India for a minimum period of 30 days before submitting the notice of intended marriage.
๐น Any of the partners should not be in a married relationship with someone else. If either of the individuals was previously married, then the necessary documentation to prove the dissolution of the previous marriage is required (e.g., divorce decree or death certificate).
๐น You donโt have to invite witnesses, you can get witnesses at the wedding venue.
๐น The legal age to get married for males is minimum 21 years, and for females, it is 18 years.
๐น A notice of their intended marriage is to be submitted to the Marriage Officer of the district where at least one of them has resided for 30 days preceding the notice.
๐น For a mandatory 30-day period the notice is published which is open for any objections to the marriage. If no objections are raised during this period, the couple can proceed with the marriage.
๐น After the expiration of the notice period, the couple can solemnize their marriage. They can do it by either a civil ceremony or a religious ceremony. The marriage must be registered within 30 days of the solemnization.
๐น Weddings are registered regardless of race, or religion of the couple.
๐น In India same sex marriage is legally not allowed.
๐น There should be an interpreter if the couple cannot understand it fully in English or Hindi or any local Indian language.
The couple must notice that the requirements and procedures may vary slightly based on the specific circumstances and the state in which the marriage takes place.
